The Ericsson settlement reinforces both the multinational breadth of FCPA jurisdiction, and the scale of fines being issued by U.S. enforcement authorities.

As part of this resolution, Ericsson agreed to engage an independent compliance monitor for three years. The process of selecting a monitor has now been completed and Dr. Andreas Pohlmann of the firm Pohlmann & Company – Compliance and Governance Advisory LLP has been appointed as Ericsson’s monitor.

In September Ericsson said it had reserved around $1.2 billion to resolve FCPA violations with the DOJ and SEC. Ericsson first disclosed the FCPA investigation in a company statement in June 2016. An Ericsson subsidiary in Egypt entered a guilty plea to an FCPA conspiracy to violate the anti-bribery, books and records, and internal controls provisions. The parent company entered into a three-year deferred prosecution agreement (DPA), which included the requirement to retain an independent monitor.

The Ericsson settlement reinforces both the multinational breadth of FCPA jurisdiction, and the scale of fines being issued by U.S. enforcement authorities. At over $1 billion USD, the fine is the second largest in the history of FCPA enforcement, with nine of the ten largest fines issued under the FCPA being against non-U.S. companies.
